0. Definitions

"Service" or "Platform": OpStack Pro and all its functionality.
"User": The person or entity that uses the Service.
"Customer": A user with an active paid plan.
"Organization": The entity under which multiple users collaborate.
"Content": Documents, queries, and data provided by the User.
"Agents": Specialized AI systems that respond to queries.

1. Acceptance and scope

By registering or using OpStack Pro, the User accepts these Terms. Use of the Service is prohibited for minors under 13. Users between 13 and 17 require consent from a legal guardian.

2. Accounts and security

The User must provide accurate information when registering and is responsible for maintaining the confidentiality of their credentials. The User must notify immediately of any unauthorized access to their account.

3. License to use

OpStack Pro grants a limited, non-exclusive, non-transferable license to use the Service under these Terms. The User retains all rights to their Content and grants OpStack Pro a non-exclusive license to process, host, and transmit it to operate the Service.

4. Plans and pricing

Early Access phase: OpStack Pro is under active development. Displayed prices are indicative and may change before official launch. Users who register during early access will keep preferential conditions.

Free plan: Available without a credit card. Message and document limits apply as shown on the pricing page.

Paid plans: When available, they are billed monthly. Pricing will be clearly communicated before purchase.

5. Cancellation and refunds

Users can cancel their subscription at any time from account settings. Cancellation takes effect at the end of the current billing period.

6. Right of withdrawal (Argentina)

Users in Argentina have a right of withdrawal under the Consumer Protection Law (Law 24.240). They may revoke the contract within 10 calendar days from acceptance. See our withdrawal policy.

7. Acceptable use

The User agrees NOT to:

  • Upload unlawful, defamatory, fraudulent content or content that infringes third-party rights
  • Attempt unauthorized access to systems or exploit vulnerabilities
  • Use the Service for spam, phishing, or malware distribution
  • Violate applicable privacy or data protection regulations
  • Exceed the Service's reasonable technical limits

Violations may result in warnings, limitation, or account suspension.

8. Availability and changes

The Service is provided "as available" during the early access phase. There may be interruptions, updates, or changes to functionality. OpStack Pro will make reasonable efforts to communicate significant changes in advance.

9. Intellectual property

The software, trademarks, design, and documentation of OpStack Pro are owned by their respective holders. The User warrants that their Content does not infringe third-party rights and grants a worldwide, royalty-free, perpetual license to suggestions or feedback to improve the Service.

10. Limitation of liability

OpStack Pro makes reasonable efforts to maintain availability and security but does not guarantee error-free or uninterrupted service.

Limitations: To the fullest extent permitted by law, OpStack Pro is not liable for indirect damages, loss of profits, or data loss. Total liability is limited to the amount paid by the User in the last 12 months.

Important note: AI Agents can make mistakes. Responses do not constitute legal, financial, or certified professional advice. The User should verify critical information with qualified professionals.

11. Data protection

Personal data processing is governed by our Privacy Policy. OpStack Pro complies with Argentina's data protection law (Law 25.326) and applies reasonable security measures.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Cordoba and the Argentine Republic.

Consumers may choose the courts of their domicile, the place of performance, or the provider's domicile, in accordance with consumer protection laws.

13. Modifications

OpStack Pro may update these Terms for legal, technical, or operational reasons. Material changes will be communicated through a visible notice in the Platform or by email. Continued use of the Service after notice constitutes acceptance of the updated Terms.

14. Security breach notification

14.1 Notification commitment. In the event of a security breach that compromises User personal data, OpStack Pro will notify affected Users within 72 hours of confirmation of the breach.

14.2 Notification content. The notification will include: (a) a description of the nature of the breach; (b) the categories and approximate number of data subjects and records concerned; (c) contact information for our representative; and (d) recommended measures to mitigate potential adverse effects.

14.3 Delayed notification. Notification may be delayed if reasonably necessary for the investigation of the breach, to preserve evidence, or as required by law enforcement.

14.4 User responsibility. Users agree to maintain accurate contact information in their account profile to ensure timely notification.

Early Access notice: OpStack Pro is in active development. Features, pricing, and terms may change. We will keep users informed of significant changes.
